Terms and Conditions for obtaining leads from PriceMySolar.co.nz

Introduction
These Website Standard Terms and Conditions and Privacy Policy was written on this webpage shall manage your use of our Website, Price My Solar accessible at www.pricemysoalr.co.nz
These terms and conditions apply to both consumers who use this site and Solar Installers who pay for information obtained from the consumer. Minors or people below 18 years old are not allowed to use this Website.
Services
The purpose of this site is to introduce you to a professional Solar installation expert. Our company will pass on your details to the experienced technician to work out the best option based on your requirements.
Any advice, installation or any other information regarding such services shall be given by the Solar installation company assigned to you and not us.
Intellectual Property Rights
Other than the Content you own, under these Terms, Price My Solar and/or its licensors own all the intellectual property rights and materials contained in this Website.
You are (the customer) is granted a limited license only for purposes of viewing the material contained on this Website. You (the Solar Installer) may not replicate, use the methods, quiz and SMS verification systems that Fly Me High Limited uses.

Payment of leads
Our site runs on credit card payments. All leads that are not paid for will be deducted from the nominated card supplied. Fly Me High Limited reserves the right to debit your credit card for all outstanding leads*
Occasionally, some cards can exceed their limit; we will supply leads and debit your card later.
By clicking on the link SUBMIT when you joined, you agree to us debiting your credit card to pay the leads we send.
All leads are billed (approx.) 72 after the lead is sent to you.
You have 72 hrs to validate the lead using the portal and video instructions we sent you upon joining.

Pre-Purchase: This is arranged by mutual agreement. All leads must start with a pre-purchase of 100 leads. After 90 leads, you will be notified and allowed to top up. All pre-purchased leads must be paid within seven days. All leads must be disputed within the same 72 hrs time frame. Disputed leads are outlined below under Disputed Leads, Credits and Billing (Solar Providers).

Restrictions
You (the customer and Solar Installer) are specifically restricted from all of the following:
A) publishing, copying or replicating the lead concept and use of SMS or any Website material in any other media;
B) selling, sublicensing and/or otherwise commercialising any Website material;
(this applies to onselling customer information to third party installers or sub-agents/contractors associated with the Solar Installer)
C) publicly performing and/or showing any Website material;
D) using this Website in any way that is or may be damaging to this Website;
E) using this Website in any way that impacts user access to this Website;
F) using this Website contrary to applicable laws and regulations, or in any way may cause harm to the Website, or to any person or business entity;
G) replicate the flow and methodology of this site for the purpose of generating your own leads for a period of 24 months.
H) engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Website;
I) using this Website to engage in any advertising or marketing.
J) You may not pass on these leads to a third party for sale or commission, even if you have bought the lead or claimed this lead as a dispute. These leads are exclusive to you.

Disputed Leads, Credits and Billing (Solar Providers)
We do acknowledge that some leads can fall through the cracks which do not meet our quality standards.
We do not guarantee the ‘intent’ of a prospect.
The Intent of a buyer can differ. The conversion of a lead to a sale will depend on the individual skillset of your contact salesperson, contact centre and process. We provide information (a lead) based on the information supplied electronically via an online assessment.
We confirm the address and phone details via SMS.
We do not give credits for non-contact, no answer, or return of email and, or SMS message, this is a cost of lead generation.
All non paid leads that are not paid for due to credit card failure will be sent for collection after seven days.
All lead payments that fail due to insufficient funds or declined transactions ‘may’ attract a $5 per lead fee (only applicable for repeated transaction failure at our discretion. We always give a warning)
The conditions of a disputed lead are in the drop-down menu inside your CRM.
Leads must be disputed with 72 hrs of the leads being passed to you verbally or via electronic communication.
Once a lead is disputed, we will check the validity of the dispute, and the billing process will stop.
If the lead falls outside our terms, we reserve the right to move the lead back to valid (in your pipeline)

You can dispute leads that fall outside our four main criteria’s below under option (5).

IMPORTANT: Leads that you can claim as invalid must fall into one of the five criteria’s below and must be done within 72 hrs.

1)     Wrong number, Wrong email, or the number was disconnected.
2)     Not the owner of the property or incorrect address.
3)     Location of the lead is outside 100km of the boundary of the region you wanted leads
4)     You have recently been contacted, directly, indirectly via your own efforts, marketing, outbound calling, or inbound call within the last 72 hrs*
5) Inside the CRM, there is an option for ‘other’. We realise some leads may have valid reasons that fall outside the four options above; these are judged case by case.

*If the contact is on your database or has been in touch, you may be required to provide evidence of communication by yourself or the vendor (prospect) that shows the contact was within 72 hrs of the lead been sent to you by Fly Me High Limited.

In some circumstances, you may be already engaged with the client beyond 72 hrs. If you have supplied a written quote or been to the property within 21 days then you can apply for an invalid lead. Beyond this time, it’s a valid lead.

IMPORTANT: In all instances above, and only if you have claimed the lead to be invalid, we reserve the right to onsell the opportunity.

We do not refund any cash credits to a nominated credit card or bank account outside 72hrs unless there is an exceptional circumstance and you no longer wish to continue with our service. This is at our discretion.

We will consider credits to your Fly Me High account ‘outside’ 72 hrs that have been missed due to unforeseen circumstances, holidays, illness or other. This is done on a case-by-case scenario.
Regions
You can update your regions and lead flow every seven days. There are exceptions to this, and it needs to be done manually. This can take up to 3 working days by emailing jenny@flymehigh.com

Services (to the consumer)
This site aims to introduce them to a professional Solar provider.
Our company will pass on the details to the experienced technician to determine the best option based on your requirements.
Any advice, installation or any other information regarding such services shall be given by the Solar installation company assigned. At most, the consumer will receive two quotes. We try to provide two quotes for comparison. Depending on your location, this may not be possible.

Service (to the Solar Installer)
Our service aims to provide you with qualified introductions for the purpose of a Solar Installation/Service. We will guarantee the information and phone number are correct. If not, we will credit back the lead by way of credit to your portal. We only classify invalid leads in accordance with points 1-5 below.
We also guarantee that the lead information will never be sent out more than twice to any third provider.

Intellectual Property Rights

Price My Solar

Collection of payments and fee’s attached

At our discretion, any leads that we have sent you beyond the 72 hrs that are more than 21 days overdue are liable to collection charges. All collections are done via eccreditcontrol.com, and their fees will be charged on top of what you owe us plus GST. Collection fees range between 20 and 30% of the total debt. Our advice. Just pay us when you ask!

Region Changes and Pausing leads

You can update your regions and lead flow every seven days. All regional lead changes can take up to 72 hrs to come into effect, whether you turn them on or off. You are responsible for all lead flow, pausing, and changing lead flow. Once you activate the leads, you must turn them off inside your portal, to which only you have access. Any requests sent by email or phone do not guarantee that these leads will stop within your time frame.
